In today’s world, employers have access to extensive resources to help with employment decisions. Although it may seem wise to gather as much information as possible regarding applicants, there are limits on what is legal. Deciding how and when to use information resources is critical to protecting employers from liability. Topics to be covered include background and credit checks, drug testing, and the use of Facebook and social media in hiring decisions. Other hiring pitfalls will also be addressed including the use of unpaid interns, the new prohibition on employment status discrimination under the New Jersey Law Against Discrimination, and the risks of providing ambiguous compensation and benefits information to new employees.

Marianne Tolomeo is a partner with Podvey Meanor in Newark, New Jersey. A graduate of Williams College and Cornell law School, Marianne is an experienced litigator with an emphasis on employment law. She has successfully defended sexual harassment, whistleblower, and wrongful termination lawsuits, and has extensive experience representing clients in restrictive covenant litigation. A significant portion of Marianne's practice is devoted to advising clients on employment matters, including harassment and retaliation complaints, leaves of absence, wage and hour issues, reasonable accommodation, and termination of employment. She has substantial experience negotiating and drafting employment contracts, severance agreements, and employee handbooks
